Advertisement: The Moshy website advertisement contained a questionnaire which said “Welcome to your weight loss consultation! We’ll be asking a few questions so our practitioners can find the best treatment for you.” The questionnaire results say, “Great news. Based on clinical studies, we estimate you may lose X kg in 12 months” The advertisement includes a weight loss graph which estimated the weight you could lose over a 12 month period regardless of how low the starting weight was.

Complaint: Socially irresponsible advertising of weight loss medicines. There is a quiz to check eligibility. If you enter a weight that would be considered underweight, the quiz still tells you ’Great news! You could lose X kg’. The quiz should not produce such a result for people who are not overweight as this medicine is only approved for people with a minimum BMI of 27. Concern this could be targeting people with eating disorders.

Decision: The Complaints Board Chair had accepted the complaint to go before the Complaints Board to consider whether the Therapeutic and Health Advertising Code had been breached. As part of the self-regulatory process, advertisers have the option of amending or removing their advertising after receiving a complaint. In this case the Advertiser confirmed they had amended the questionnaire, removing the projected weight loss graph result from the advertisement.

Given the Advertiser’s co-operative engagement with the process by amending
the advertisement, the Chair ruled the complaint was settled.
